Any import of dumped or subsidized products which, when released for consumption, causes or threatens to cause material injury to like domestic production, or significantly delays the creation or development of like domestic production, is deemed an unfair import practice.
The following are considered to be dumped:
- Dumping, any product whose export price to Cameroon is lower than its normal value or that of a similar product found in the course of normal commercial activities in the country of export or origin;
- A subsidy, any product which has benefited in the country of export or origin from a direct or indirect premium for production, processing, export or transport.
An anti-dumping or countervailing duty may be imposed on any dumped or subsidized product.
The amount of the countervailing duty provided for above may not exceed the dumping margin or the amount of the subsidy.
Provisional and definitive anti-dumping or countervailing duties are established in accordance with the legal and regulatory framework in force, on the proposal of the Minister responsible for foreign trade. These duties are assessed and collected in the same way as customs duties.
