Applications for approval to enter the forestry profession, applications for the granting, renewal, transfer or relinquishment of forestry licenses, and applications for special permits to harvest medicinal plants, are processed by the Administration in charge of Forests, on the advice of a Technical Commission composed as follows:
– The Minister in charge of Forests or his representative ……………………………….. Chairman;
– A representative of the National Assembly ………………………………………….Member;
– A representative of the Minister of Territorial Administration;
– A representative of the Minister of Finance;
– A representative of the Minister of the Economy and Planning;
– A representative of the Minister of Urban Planning and Housing;
– A representative of the Minister of Mines and Energy;
– The Délégué Général à la Sûreté Nationale or his representative;
– The General Delegate for Tourism or his representative;
– The Director of Forests.
The Minister in charge of forests may summon any other person of his choice in view of his competence.
The Technical Commission is convened by the Minister for Forests as and when required, and in any event at least twice a year.
The Technical Commission may only validly deliberate if at least 2/3 of its members are present;
Opinions of the Technical Commission are issued by a simple majority of votes, with the Chairman casting the deciding vote.
The opinion of the technical commission may be:
– Favorable if all criteria are met;
– Conditionally favorable, when further information is required. In this case, the applicant has three months from the date of notification of the opinion to provide the additional information. Once this period has elapsed, the committee’s opinion ceases to be favorable;
– Postponed when one of the major criteria for valid consideration of the application is missing.
In this case, the applicant has a period of three months from the date of notification of the decision to complete his or her file, with a view to re-examining it at the next session of the Technical Commission;
– Unfavorable when the application does not meet regulatory criteria.
The minutes of each Technical Commission meeting are signed by its Chairman and submitted to the Minister in charge of Forests for approval.
