The operator of any classified establishment is required to draw up an emergency plan to ensure that alerting the competent authorities and neighbouring populations in the event of an incident or threat of an incident the evacuation of personnel, as well as the means to contain the causes of the incident.
The emergency plan must be approved by the relevant authorities, who will periodically check that that the equipment used to implement the plan is in good condition and reliable.
Any change in the operator or name of a classified establishment must be declared.
Any transfer to another location or any modification to a classified establishment is subject, depending on the class, to an application for additional authorization or a new declaration.
When an authorized or declared classified establishment is not operational within two (2) years of notification of the authorization or issue of the declaration receipt, or is not operated for two (2) consecutive years, the manufacturer must apply for a new authorization or make a new declaration in order to resume operations.
The Minister responsible for classified establishments may close a classified establishment whose operation presents, for the interests mentioned above, the dangers and inconveniences mentioned above.
