Any natural or legal person requesting the transfer to him or herself of the right to exploit an area previously licensed to another forestry operator must first be approved by the forestry profession.
Requests for transfer shall be addressed simultaneously by both parties to the Minister responsible for forests.
In addition, the transferee must submit the regulatory licensing file provided for in Art. 30 of the present law.
In the event of agreement to the principle of transfer, the transferee must complete this file by producing a receipt certifying payment of the transfer fee and bond.
The transfer is sanctioned by the licensing authority. It concerns the entire area covered by the license.
All clauses of the specifications not yet executed by the previous licensee are incumbent on the transferee.
New special clauses may be drawn up to take account of the new surface areas resulting from the transfer.
Exploitation of the transferred forest area may only commence after notification of the transfer deed by the Administration in charge of forests and payment of all fees or taxes relating to the transfer.
