Rent
The rent is decided freely between the parties, unless any applicable national legislation provides otherwise. It may be revised in accordance with the provision of the lease agreement or, failing any such provisions, every three years.
In the event of the parties being unable to agree upon a revision of the rent, either party may make an application to the court to set the rent.
Duration
Commercial leases may be entered into for either a fixed or indefinite period.
Renewal
The provisions of the Uniform Act relating to renewal are all mandatory and cannot be varied by contract. Whether the lease is for a fixed or an indefinite term, a lessee who can demonstrate that he has used the premises properly, for purposes of the activity stipulated in the contract and for a period of at least two years, is entitled to renewal.
In either case, the renewal is for three-year period unless otherwise agreed by the parties.
If the lease is for a fixed term, the lessee must serve a notice of renewal on the lessor by bailiff three months before expiry, failing which his right to renewal lapses. If for an indefinite term, the notice period is six months.
