Commercial lotteries organized by natural or legal persons under private law are authorized by:
– Order of the Minister responsible for gaming when the operating territory covers more than one Region;
– Decision of the Governor of the Region with territorial jurisdiction when the operating territory covers a single Region.
The duration of the authorizations referred to in paragraph 1 above may not exceed three (03) months. Any new application for authorization for the same purpose may not be submitted less than two (02) months after the expiry of the previous authorization.
The following may be authorized:
– Raffles the proceeds of which are intended for charitable works, the encouragement of the arts and/or the promotion of sporting and cultural activities;
– Raffles organized on the occasion of commercial promotions, fairs, exhibitions, fairs, circuses, appeals to the generosity.
The commercial lottery or tombola ends at the end of the event to which it is linked.
Authorization to organize a commercial lottery or raffle is subject to production, by the applicant or the representative of a legal entity, of a file comprising:
– A stamped application specifying:
. The surname(s) and first name(s) of the promoter or the promoter’s company name in the case of a legal entity a legal entity;
. The promoter’s place of residence;
. The nature of the commercial lottery game(s) to be operated;
. The charity, sporting activity or artistic field to be promoted or encouraged; etc.
– A guarantee given by a bank covering the total value of the cash or in-kind prizes to be distributed;
– Rules of the game authenticated by a bailiff and specifying:
. The number and list of prizes in cash or in kind and their value;
. The number of tickets to be issued and the value of each ticket;
. The period during which the game(s) is/are to take place;
. The territory in which the game(s) will be played; etc.
– A certified copy of a valid national identity card or residence permit if the promoter is of foreign nationality, or the company’s articles of association if the promoter is a legal entity;
