The operation of a casino, betting establishment or public lottery is subject to a concession contract signed by the Minister responsible for gaming and the promoter, after obtaining the opinion of the Gaming Regulatory Agency.
The term of the concession is ten (10) years, renewable under the conditions set out in Articles 6 and 7 of the law.
The concession contract referred to above specifies in particular:
- The type of games authorized and their operation
- The opening and closing hours of the gaming rooms;
- The technical characteristics of the games
- The types of connection contracts with the various partners, where applicable;
- The promoter’s commitments.
The signing of the concession contract for the operation of a casino, betting establishment or public lottery is subject to the production by the applicant or the representative of a legal entity of a file in five (05) copies including:
a) Stamped request specifying
– The surname and first name(s) of the promoter or, in the case of a legal entity, its company name;
– The promoter’s place of residence
– The location of the casino, betting establishment or lottery operator
public lottery operating company;
– The promoter’s statistical number;
b) A draft concession contract;
c) Draft specifications drawn up in accordance with the provisions of Article 19 of the aforementioned Act No. 2015/012 of 16 July 2015;
d) An extract from the criminal record (bulletin no. 3) of the main managers of less than three (3) months old;
e) A copy of the registration with the Registre du Commerce et du Crédit Mobilier (RCCM);
f) A certified copy of the taxpayer’s card;
g) A certificate of non-royalty;
h) A certificate of location issued by the tax office with territorial with territorial jurisdiction;
i) A detailed description of the games to be operated;
j) A bank guarantee certificate;
Five (05) copies of the file referred to above must be deposited with the Gaming Regulatory Agency, which is required to forward it within thirty (30) days to the Minister in charge of gaming, together with his or her opinion.
The Minister in charge of gaming has a period of ninety (90) days from the date of receipt of the application to issue the concession or to reject the application. After this period, the authorization is deemed to have been granted.
During the period provided for above, the Minister responsible for gaming may request additional information from the applicant, or initiate a character investigation. In such cases, the deadline for signing of the concession is suspended until the applicant provides the required information, or the closure of the said investigation.
Any casino, betting establishment or public lottery operating company must be located in premises that meet the technical, quality and comfort requirements
Importation of machines, equipment and other materials intended for casinos, betting establishments or companies operating public lotteries is subject to the authorization by the Minister responsible for trade, upon presentation of the concession contract.
Before being put into operation, machines, apparatus and other equipment assembled, manufactured locally or imported, and intended for use in games must be approved in accordance with legislation on legal metrology.
The Gaming Regulatory Agency ensures that the approval provided for above complies with the model approved by the Minister responsible for gaming.
Copies of the approval documents are sent to the Minister responsible for gaming and to the Minister responsible for trade.
The promoters of casinos, betting establishments or public lottery companies are required to submit a declaration of activity to the Minister in charge of gaming and to the structure in charge of financial investigations, including proof of the origin of the necessary funds.
