A Technical Commission is hereby created, hereinafter referred to as the “Commission”, to study applications for approval and monitor the activities of NGOs.
The Commission is made up of representatives of public authorities and members of civil society.
Representatives of funding bodies may be admitted to take part in the work of the Commission sitting in the context of monitoring the control of NGOs, and when the said bodies have made a financial contribution to these NGOs.
It issues an opinion on any question relating to the approval and/or monitoring of NGO activities, subject to the cases of dissolution provided for in the law.
A decree implementing the present law specifies the organization and operation of the Commission.
The Commission has a maximum of thirty (30) days from receipt of the approval file to forward it, with reasons, to the Minister in charge of Territorial Administration.
Approval for NGO status is granted after consultation with the Commission, by order of the Minister responsible for Territorial Administration.
The Minister in charge of Territorial Administration makes his decision within a maximum period of seventy-five (75) days from the date on which the application is submitted to the Governor.
After this deadline, and if the Minister fails to notify the founder(s) or representative(s) of the NGO of the rejection and the reasons for the rejection of the application, approval is deemed to have been granted.
Approval granted in one of the cases referred to in paragraphs (1) and (2) above entails the acquisition of legal personality by the NGO.
Approval is granted for a renewable period of five (5) years.
At the end of the three (3) year period provided for in article 5 (1) above, approval for a renewable period of five (5) years may be granted to a single-member NGO, subject to the opinion of the Board of Directors. five (5) years, renewable, may be granted to a one-person NGO after consultation with the commission.
Unless otherwise decided by the Administration, approval is renewed by tacit agreement at the end of a five (5) year period for the same duration.
Approval is personal, non-transferable and non-assignable.
