Any person who wishes to set up and/or operate an installation comprising one or more works allowing the abstraction of surface or ground water for industrial or commercial purposes, submits an application for authorisation to the Minister responsible for water.
The application for authorisation, the original of which is stamped at the current rate, is submitted in four (4) copies to the competent divisional delegation of the administration in charge of water. It includes:
• The completed, signed and stamped regulatory form at the current rate;
• An impact assessment together with the relevant decision of the environmental authority;
• An extract of the cadastral plan declared compliant by the administration in charge of domains, situating the project in its environment;
• An extract of the map of the region at a scale of 1:10,000 showing the position of the water intake;
• A payment receipt from the intermediary revenue agent of the Ministry in charge of water attesting to the payment for the opening and study of the file of a sum of:
– Fifty thousand (50,000) CFA francs for abstractions of less than one hundred (100) cubic metres of water per day;
– Two hundred thousand (200,000) CFA francs for abstractions between one hundred (100) and five hundred (500) cubic metres of water per day;
– Three hundred thousand (300,000) CFA francs for abstractions of between five hundred (500) and one thousand (1,000) cubic metres of water per day;
– Five hundred thousand (500,000) CFA francs for abstractions exceeding one thousand (1,000) cubic metres of water per day.
• The results of physical-chemical and bacteriological analyses of the water;
• A certificate of environmental compliance;
• Any other additional information required by the water authority.
If the installation of a water abstraction system for industrial or commercial purposes requires a building permit, the application for authorisation must be accompanied by the said permit.
The abstraction authorisation is granted by order of the Minister in charge of water, subject to the rights of third parties, for a renewable period of five (5) years. Within one month from the date of submission of the application, the Minister in charge of water may, if necessary, open a public enquiry. He appoints investigating commissioners for this purpose. The opening of this enquiry is published by:
– The Senior Divisional Officer of the division where the abstraction facility is located;
– The Divisional Officer of the Sub Division concerned;
– The Mayor of the council in which the facility is located.
Supervision and control of water abstraction facilities are carried out under the authority of the Minister in charge of water by sworn agents commissioned for this purpose; the operators or those in charge of water abstraction facilities are required to facilitate access to the sworn agents.
