Harmful and/or dangerous chemical substances which, because of their toxicity or concentration in biological concentration in biological chains, present or are likely to present a danger to human health, the natural environment and the environment in general, when they are produced, imported into the national territory or discharged into the environment, are subject to the control and technical administrations, in conjunction with the administration in charge of the environment.
Radioactive substances are governed by a specific law.
A decree implementing this law, issued on the basis of a joint report from the competent authorities, regulates and sets out:
– The obligations of manufacturers and importers of chemical substances intended for marketing, the composition of preparations placed on the market and the volume to be marketed;
– The list of substances whose production, import, transit and circulation within the national territory are prohibited or subject to prior authorization by the Administrations responsible for the control and monitoring of chemical, noxious and hazardous substances;
– The conditions, mode, route and timetable of transport, as well as any requirements relating to the packaging and marketing of the above substances;
– The conditions for issuing prior authorization;
– The list of substances for which the production, import, transit and movement on national territory are authorized.
Noxious and dangerous chemical substances manufactured, imported or offered for sale in breach of the provisions of this law shall be seized by the competent fraud prevention officers or sworn officers of the competent authorities.
Where the substances referred to above present a real and imminent danger, they must be destroyed or neutralized as soon as possible by the authorities referred to in the above paragraph at the expense of the offender.
