Factories, workshops, warehouses, building sites and, in general, industrial, craft or commercial facilities operated or owned by any natural or legal person, public or private, which present or may present a danger to health, safety, public health, agriculture, nature or the environment in general, or which may present an inconvenience to the general public, are subject to the provisions of the legislation and regulations in force on classified establishments, the environment in general, or inconvenience of the neighbourhood.
In order to prevent and control accidents in classified establishments, the person in charge of a classified industrial or commercial establishment is required to carry out a hazard study.
The study of the hazards referred to above must include the following information:
– Identification and description of hazards according to their internal or external origin;
– Risks to the environment and neighbours;
– Justification of the techniques and processes envisaged to prevent the risks, or to limit or compensate for their effects;
– Plant design;
– Operating instructions;
– Means of detection and response in the event of an incident.
The operator of any first- or second-class establishment, as defined by legislation on classified establishments, is required to draw up an emergency plan to ensure that the competent authorities and neighbouring populations in the event of an incident or threat of incident, the evacuation of personnel and the means to contain the causes of the incident.
The emergency plan must be approved by the relevant authorities, who will periodically check that the equipment used to implement the plan is in good condition and reliable.
