Emissions of noise and odours likely to harm human health, constitute an excessive nuisance for neighbours or harm the environment are prohibited.
The persons responsible for such emissions must take all necessary steps to eliminate, prevent or limit their propagation without necessity or lack of precaution.
Where warranted by the urgency of the situation, the local authorities must take all enforceable measures to stop the disturbance. If necessary, they may request the assistance of the police force.
A decree implementing the law, issued on the basis of a joint report from the competent authorities shall determine:
– The cases in which, and the conditions under which, noise caused without absolute necessity or due to a lack of precaution;
– The conditions under which buildings, industrial, commercial, craft or agricultural establishments vehicles or other movable property owned, operated or held by any natural or legal person, must be operated, constructed or used in such a way as to comply with the provisions of the law and its implementing regulations;
– The conditions under which all enforceable measures must be taken by the local authorities to put an end to the disturbance on their own initiative, without prejudice to any criminal penalties that may be imposed;
– The deadlines by which the provisions of the law must be complied with on the date of publication of each regulation issued for its application.
