Certificate Requirement
no person may operate a training organisation unless he has first obtained a certificate of approval.
No person may carry out training, examinations or checks on aircraft in flight or on flight simulators unless he has first obtained a certificate of approval.
The certificate of approval is issued by the Aeronautical Authority to the applicant after he has demonstrated that he meets the requirements of these regulations.
Request for release or amendment
the applicant for a certificate of approval must submit an application to the aviation authority at least ninety (90) days before the commencement of any scheduled training in the prescribed form.
The application for the issue of a certificate of approval or for the amendment of a certificate shall include:
– An application bearing the company name and address of each site of activity used;
– A declaration that the minimum qualification requirements for each command post will be met;
– A statement acknowledging that the applicant must notify the Aviation Authority of any change in the assignment of persons to the required command positions within 10 working days of such change;
– The training specifications which the applicant proposes to apply for etc.
The applicant for a certificate of approval must ensure that the facilities and equipment described in the application are available for inspection and assessment before the certificate of approval is issued.
The Aviation Authority may refuse, suspend, revoke or terminate a Certificate of Approval, if it considers that the applicant or the holder of the Certificate:
– Holds a certificate of authorisation which has been revoked, suspended or terminated within the previous 5 years; or
– Employs or proposes to employ a person who:
1. was previously employed in a position of command or supervision by the holder of a certificate of approval which was revoked, suspended or terminated within the preceding five (5) years;
2. exercised authority over a certificate holder whose certificate was revoked, suspended, or terminated within the last five (05) years and;
3. has materially contributed to the revocation, suspension, or termination of such certificate and who is employed in a position of command or supervision, or who exercises authority over, or has a substantial proprietary interest in, the organization, etc.; or
The aeronautical authority may amend a certificate of approval on its own initiative or at the justified request of the holder of the certificate.
When the amendment is initiated by the holder of the certificate, the request for amendment shall be filed with the aeronautical authority at least sixty (60) days before the effective date proposed for the amendment.
