The real estate agent carries out his activities in a specially designed and decent environment.
This framework is subject to control by agents of the territorially competent minister responsible for housing at the start of the exercise of the profession and annually.
The real estate agent keeps a register listing all payments or remittances made to him in the course of his profession. This register includes a column indicating the number of the receipt issued to the client. It is kept for ten (10) years and must be submitted to the control of the agents of the ministry responsible for housing at each of their requests.
The register directory does not exempt the real estate agent from keeping other accounting or statutory registers provided for by the regulations in force. The register is kept under the personal responsibility of the holder of the professional card.
Any payment or remittance of funds made to a real estate agent gives rise to the issue of a receipt taken from a special stub book.
All acts drawn up by the real estate agent relating to the rental or sale of real estate are drawn up in notarial form.
Requirements:
- Be a natural or legal person;
- Be a real estate professional;
For individuals:
✓ hold: –
- Either a Bachelor’s degree, following legal, economic, or any equivalent diploma; – – or an engineering diploma.
- A degree in civil engineering, urban planning or architecture;
- Or one of the diplomas issued by the State or by a State-approved by the State and appearing on the list drawn up by joint order of the Ministers in charge of housing and higher education respectively.
✓ Or hold a bachelor’s degree, with proof of professional experience of at least ten (10) years, and having held:
- A permanent position in organizations that carry out real estate operations;
- A job in an establishment under the authority of a holder of the professional real estate agent’s card;
- A public position related to real estate transactions or property management.
✓ For people who manage a company, such as managers, agents or such as managers, agents or those of a sole proprietorship:
- Provide proof of professional competence;
- Have practised for at least five (5) years on a permanent basis.
For legal entities:
– Meet the conditions for exercising the profession of trader;
– Employ at least one natural person who meets the conditions for exercising the profession of trader.
