In the context of its relations with third parties, the real estate developer acts on the basis of a real estate development contract. The latter is a mandate of common interest by which a person called a “real estate developer” undertakes towards the owner of a project to have the delivery of work(s) and/or the completion of a construction program for one or more buildings carried out for a price agreed by means of contract(s) as well as to carry out himself or have carried out for an agreed remuneration, all or part of the legal, administrative and financial operations contributing to the same object.
NB: Public or private developers act as sellers or service providers. When they act as service providers, public real estate developers are exempt from the obligation to conclude a promotion contract.
